In the interest of respecting the passing of Ledger, I have some ideas for how fans can "see" the Joker in the sequel without recasting.
Newspapers
Prominently displayed papers (ala Batman Returns) can give the impression that the character is still alive
Radio news segments
Have a character walk into a bar or room with a radio on while a newscaster finishes a statement;
"... reports of those affected by the recent outbreak of "Joker Fish" poisonings continue to come in with every hour. As long as the Joker remains on the streets, the body count will rise."
Television
Kind of like the Gotham Tonight segments, but with a "retrospective" on those killed in the Joker's wake, including Mike Engel.

I could see that. There should definitely be at least some reference to the Joker.

I could see that. There should definitely be at least some reference to the Joker. Should WB even consider making Joker figures for an extra villain in 2011? It'd be nice to be able to find Joker figures without horrible individuals purchasing them in hordes in order to artificially drive up the prices

I think cameos are a great idea. I particularly like your "Joker Fish" idea.
IF they shot a scene in Arkham, say... Gordon & Batman discussing Harvey while walking through a hall filled with cells. They stop infront of a door & continue their conversation. When from the cell: "You wanna know how I got these scars?" Gordon & Bats: "No" they walk off & continue talking about whatever, & you faintly here the Joker talking to noone about his father & the kitchen knife.

I particularly like your "Joker Fish" idea. ;D That's pretty much the only way I'd like to see it on-screen; I thought Batman: The Animated Series did a terrific job adapting it already. That'd be funny; I'll fork this thread to continue something I've been thinking about.

They could always do like they did in Birds of Prey, a stand in with Mark Hammil providing the voice

That would be awesome and a tad weird; if I were working for WB, I'd "test the waters" and find out what the fans wanted prior to diving head-first into this.
